Terms and Conditions
These selling terms and conditions are subject to the Italian Law and in particular to the legislative Decree #21 of February 21, 2014, (so called Attuazione della direttiva 2011/83/UE on consumer’s rights), modified by the Legislation 93/13/CEE and 1999/44/CE and that abrogates the Legislations 85/85/577/CEE and 97/7/CE and that modifies the legislative Decree #206 of September 6, 2005 – “Consumer Code”.
INTRODUCTION
This contract is stipulated between REAL DIAMOND INVEST SRL, Piazza Castello, 1 – 20121 Milano, P.I. 08135960014 (hereafter “ROMANODIAMONDS.COM”) and the final consumer (according to Clause 3, paragraph 3, letter a) of the legislative Decree #206 of September 6, 2005, modified by the legislative Decree #21 of February, 2014; “a natural person not acting for trade or entrepreneurial purposes”) (hereafter, also “Client” or “Partner Client”) and it is configurable as “distance contract” (subject to Clause 45, paragraph 1, letter g), legislative Decree 206/2005, modified by legislative Decree 21/2014: “any contract concluded between the supplier and the consumer under an organized regime of sales or performance of remote services without the simultaneous physical presence of the supplier and the consumer, by making exclusive use of one or more means of distance communication up to and including the time at which the contract is concluded. “It is regulated by the legislative Decree #21 of February 21, 2014, (so called Attuazione della direttiva 2011/83/UE on consumer’s rights) and regards the trade of movable goods in the quantity and quality chosen by the consumer from the whole selection of products in the catalogue on the website.
Under this contract ROMANODIAMONDS.COM transfers or agrees to transfer the property of these goods to the Client and the Client pays or agrees to pay their price.
It is specified that the sale is intended for the final consumer. Reselling is not allowed.
HOW TO ORDER – SALES CONTRACT
To place orders at ROMANODIAMONDS.COM Clients must:
- be an individual as defined as “Final Customer”
- Be 18 years older
- Be eligible and competent to enter legally binding contracts
- Have a valid email address
- Have at least one of the following: a Valid Credit Card (Visa, American Express, Mastercard), a verified PayPal Account, or a Bank Account
You can place an order by entering into the specific area on the website and subscribe your personal data: first name and last name, e-mail, password and date of birth, address, postcode, city, telephone number and further details, if any, for the courier in the specific “notes” box.
If you are already logged into the website, you can go on and place your order.
The delivery address and all the required information about the invoicing will be underlined.
You can select the products on the on-line catalogue: click on the product, complete all the required fields and add it to cart, you can enter the cart by clicking on “Check out” box. Your cart will be made up of the description and the quantity of the products, as well as the total amount of the order. The amount to pay for shipping and delivery will be displayed as well.
In the purchase process, you may insert any potential “Promo Code”, if you have one: the discount will be applied to the order that you indicated.
The sales contract will be completed by clicking on “Submit your order and pay” box. In the same page, you can choose the method of payment more suitable for you (see “Accepted methods of payment”), but, firstly, you must click on the specific box to confirm that you have read and accepted our sales conditions.
Only sales contracts concluded by adults are considered valid. In case of minors, orders will not be considered valid and will not be fulfilled.
ORDER PROCESSING
ROMANODIAMONDS.COM reserves the right to decline an order in the event that the order does not receive express verification or approval from the Client’s bank.
Once an order is placed for available items, no changes can be made to that order.
Orders placed separately will be shipped separately.
ROMANODIAMONDS.COM reserves the right to delay a shipment if the order is not able to be shipped for reasons beyond our control. Please note that during promotions and sales there may be delays in immediate shipping.
ROMANODIAMONDS.COM reserves the right to decline to process an order and/or offer services to anyone at any time.
DESCRIPTION OF PRODUCTS, CHARACTERISTICS AND PRICES
Characteristics and descriptions of each product are available on the website www.romanodiamonds.com.
All prices published online include VAT and any other possible tax, also the prices of possible containers and packaging. The validity of promotions and offers is displayed on the product or on the section of the offer as well as the prices. Any optional cost will be indicated on the product on which the cost is applied.
On the website, images and description of details are available for each product, as well as the table to choose the right size.

NOT REQUIRED SUPPLIES
Unless the Client gives his/her consent, which must be expressed in advance or when the contract is about to be concluded, ROMANODIAMONDS.COM will not give any supply different from the established one, even if it has equal or better value, quantity and quality.
If the Client receives a not required supply, we invite the Client to immediately call at +390238317780 or email to: info@realdiamondinvest.it, so that ROMANODIAMONDS.COM will collect this supply and the amount paid will be refunded.
DECLINATION OF RESPONSIBILITY
ROMANODIAMONDS.COM publishes information on its website to provide a service to Users, but declines any responsibility of the possibility of eventual technical inaccuracy and/or typographical errors. Once notified, ROMANODIAMONDS.COM will execute an immediate correction.
ROMANODIAMONDS.COM also reserves the right to make corrections and changes to the website when necessary without giving prior notice.
ROMANODIAMONDS.COM does not offer any guaranty that the information published on its website is in conformity with the laws of the User’s competent jurisdiction.
ROMANODIAMONDS.COM declines any responsibility from eventual problems, damages, viruses or risk that the User may incur during the misuse of the website.
ROMANODIAMONDS.COM, guarantees that its website www.romanodiamonds.com is a protected website according to International Internet standards which, if used correctly, Users can be reassured not to encounter viruses.
ROMANODIAMONDS.COM declines any responsibility from eventual faulty operations of the website due to the deactivation of “cookies” in the User’s browser.

REAL DIAMOND INVEST SRL is the owner of ROMANODIAMONDS.COM and its contents. This includes, but is not limited to, the documentation, images, characters, design, music, software, codes and format scripts. The material included in the website is protected by copyright.
Reproduction, modification, transmission, re-publication and/or re-distribution to third parties for commercial purposes are strictly prohibited without the express written consent from REAL DIAMOND INVEST SRL.

LEGAL GUARANTY
Objects and accessories that may combine with offers are covered by guaranty for 2 (two) years for any manufacturing or functioning defect. Damages due to wear, improper use, wrong maintenance, loss, theft, fire and circumstances beyond our control are not covered by guaranty.
The legal guaranty of conformity protects the Client in the event he/she purchases a defective product, that does not work properly or does not comply with the correct use stated by ROMANODIAMONDS.COM. The Client can assert his/her own rights upon the legal guaranty of conformity by speaking directly to the producer of that good. In case of lack of conformity, the Client has the right to get back a repair or replacement according to his/her choice, without any charge, unless the requested repair or replacement is impossible to get or excessively onerous than the defective product. If the substitution or the replacement are not possible, the Client has the right to have a price reduction or get back an amount, in proportion to the value of the product, in return of the defective product to ROMANODIAMONDS.COM or to third parties as if indicated by ROMANODIAMONDS.COM. The legal guaranty lasts 2 (two) years since the delivery of the good, but the Client must communicate any possibile defects within 2 (two) months from the day on which clients receive the goods purchased.
COURT OF JURISDICTION
For any civil disputes between ROMANODIAMONDS.COM and the Client depending on the regulatory interpretation and on the conditions above, the court of jurisdiction is exclusively at the operational headquarters of REAL DIAMOND INVEST SRL. Yet, only REAL DIAMOND INVEST SRL has the authority to appeal to legal authority belonging to the area where the Client is resident or domiciled, if he/she lives in the Italian State.
ITALIAN LAW
Entering this website the User agrees that the laws and the regulations of the Italian State will enforce any questions pertinent to the use of the website ROMANODIAMONDS.COM
ROMANODIAMONDS.COM does not guarantee in any way that materials present on the website are in accordance with current regulations of other countries, and the access to those materials from places where the relative contents are illegal is expressly prohibited.
